FDCPA Client Book — Collector Is Served With The FDCPA Lawsuit

Here is another excerpt from our book that is for our Alabama clients who have sued an abusive debt collector under the Fair Debt Collection Practices Act (FDCPA).

The court will send out a copy of the FDCPA lawsuit, the complaint, to the defendant debt collector through its “registered agent.”

Every company must have what is known as its  “registered agent” which is simply someone or some company that is designated to receive a copy of any lawsuits.

When the registered agent gets a copy of the lawsuit, the clock starts running for the debt collector to respond to the lawsuit. We will let you know when the defendant debt collector is served and when the exact date the answer is due.

Do keep in mind that the answer date can be pushed back but normally it will not be extended by the court more than 14 days. The official time is 21 days to respond from the date of service. So the bottom line is we should hear from the collector in about 5-6 weeks from the date we file the lawsuit.
